The production of CBD derived from industrial hemp has been legal in America since 2014. But the Drug Enforcement Agency (DEA) still considered any cannabis extract, including CBD, as a schedule I drug. So the use and sale of CBD was federally illegal in the United States till 2018. With the agricultural act of 2018, CBD extracted from industrial hemp is legal and not considered as a schedule I drug anymore.

This act of congress in 2018 helped the Utah legislators to make laws on the use, sale and production of CBD and its products. The Utah legislature passed the Utah Medical Cannabis Act on December 3, 2018. This helped the Utah Department of Health (UDOH) to issue marijuana cards to patients who need CBD for the treatment of certain health conditions. Therefore, it is legal to own CBD or its products in Utah if you have a medical marijuana card issued by UDOH.

It is still legal to own CBD products without a medical marijuana card. But the only condition is that the THC content in the CBD product should be less than 0.3 %. In Utah the CBD products must be approved by the state before selling it in the general market. Since it legalization, around 30 CBD products are approved by the state.

Do I need a Prescription to Use CBD Oil in Utah?

In Utah, CBD oil is not available with the prescription of a doctor. But they can prescribe Epidiolex, a pharmaceutical version of CBD. It is recommended to consult a medical professional for determining the dosage of CBD oil for consumption before you use it for health benefits.
